GDPR compliant data protection and confidentiality policy The information about confidentiality in no way contravenes your rights under the General Data Protection Regulation May 2018 to access personal data that I, Dr Jonathan Pointer, and owner of onlinetalkingtherapy.com, hold on you. I keep confidential records. All records are kept securely. These records are subject to the General Data Protection Regulation May 2018. Some of the information I may collect is classified as sensitive personal data and I can only use such data where I have your explicit consent. This data may include: racial or ethnic origin, political opinions, religious beliefs, trade union membership, physical or mental health, sexual life, criminal proceedings and offences. Your personal and sensitive personal data will only be used in order to provide the service to you and for managing and quality assuring the service. Records are kept for a period of 7 years and are then destroyed. Further details are specified below.
Correspondence To work with you, I will need to have and store your email, telephone number, and Skype/FaceTime username/email and IP address.
HMRC Although unlikely, it is possible that HMRC may want to see my bank statements in relation to my private work as a psychologist. If this happens, HMRC would see your name, bank account number, and the amount of money that you have transferred in to my account. However, they would not be at liberty to share your information with third parties.
Information collected from visiting onlinetalkingtherapy.com In general, you can visit www.onlinetalkingtherapy.com at any time without telling me who you are or revealing any information about yourself. However, I do log the IP address, type of operating system and browser software used by each visitor, and from this information I can derive the identity of the visitor’s geographic location and Internet Service Provider. I use this data in aggregate form to build a higher quality, more useful site by analyzing the collective characteristics of my visitors and measuring the usage of each area of my site.
Disclosure to third parties, risk, and shared confidentiality
I do not sell, trade or otherwise transfer any personal identifying information to outside parties, with the following exceptions:
As a clinical psychologist and psychotherapist, I am required to have clinical supervision. Any content from therapy sessions, which is discussed with my supervisor, will be considered “shared confidentiality.”
If a client of mine needs the medical and/or emergency services, I will seek the client’s permission in advance of seeking said support. However, if any of my clients are at risk to themselves or others, I am duty bound to share this information with the appropriate medical and/or emergency services, and thus, at these times, I may need to bypass the client’s consent.
Third party links From time to time, onlinetalkingtherapy.com may contain links to other internet sites. I encourage all of our partners, contributors, and third parties to implement policies and practices that respect the privacy of my visitors. However, onlinetalkingtherapy.com is not responsible for the privacy practices of the content of such web sites.
Subject access requests I recognise that on rare occasions clients may wish to exercise their rights under the General Data Protection Regulation May 2018 and make a subject access request in respect of their personal information held by myself. If at any time you wish to exercise your right under the Act you should put your request in writing to me, along with paying a few of £10, and provide evidence of your identity such as a copy of your passport or driver’s license and proof of your address. When I receive your written request, the £10 fee, and evidence of identity, I will respond to your request within 40 calendar days. My response to a valid subject access request will normally be in the form of a schedule listing and describing the personal data I hold on you (such as your name, contact details, and if requested, a brief summary of our work together, not an expansive report).
